Terms of Service
1. Acceptance of Terms
By creating an account, accessing, or using the LimitPixel Cloud services, Orca AI, Game Engine, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
We reserve the right to modify these Terms at any time. Your continued use of the Service constitutes acceptance of such modifications.
2. Account Registration & Security
You are responsible for maintaining the confidentiality of your account credentials. You are fully responsible for all activities that occur under your account.
LimitPixel utilizes AES-256 encryption. If you lose your account credentials, we may not be able to recover your encrypted data. You acknowledge that you are solely responsible for managing your passwords and access keys.
3. Acceptable Use Policy
You agree not to use the Service to:
- Upload, store, or share content that is illegal, harmful, threatening, abusive, tortious, defamatory, or pornographic (including CSAM).
- Distribute malware, viruses, trojan horses, or any other malicious code.
- Infringe upon the intellectual property rights of others.
- Attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.
- Use the Service for crypto-mining or other excessive resource-consuming activities not related to standard storage usage.
LimitPixel reserves the right to remove any content and ban any user found violating this policy without refund.
4. User Content & DMCA
You retain full ownership of the files you upload to LimitPixel ("User Content"). We do not claim ownership over your data.
DMCA Compliance: We respect the intellectual property rights of others. If we receive a valid Digital Millennium Copyright Act (DMCA) notice regarding your content, we are required by law to remove the infringing material and may terminate repeat infringers.
5. Subscription, Billing & Inactivity
Payments: Paid subscriptions (Pro, Elite, Student) are billed in advance on a monthly or yearly basis via our third-party payment processor, Stripe.
Cancellation: You may cancel your subscription at any time via the Dashboard. Cancellation takes effect at the end of the current billing cycle.
Refunds: Payments are non-refundable, except where required by law.
To ensure optimal service performance, Free Tier accounts must log in at least once every 30 days. Accounts that remain inactive for more than 30 days may be archived or deleted to free up server resources. Paid accounts are exempt from this rule.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIMITPIXEL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
- ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
- ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICE;
- ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH OUR SERVICE.
Privacy Policy
1. Information We Collect
We collect information necessary to provide the Service:
- Account Information: Email address, username, and password (hashed).
- Usage Data: IP addresses, browser type, device information, and logs of file interactions (uploads, downloads).
- Payment Information: Processed securely by Stripe. LimitPixel does not store your full credit card details.
- User Files: We store the files you upload. While we host these files, our encryption measures (AES-256) ensure that we cannot access the contents of your private encrypted files.
2. How We Use Information
We use your information to:
- Provide, operate, and maintain the LimitPixel Cloud and Ecosystem.
- Process transactions and manage your subscription.
- Send you technical notices, updates, security alerts, and support messages.
- Detect and prevent fraud, abuse, and security incidents.
3. Data Storage & Security
Storage Provider: Your files are stored using Wasabi Technologies, LLC ("Wasabi"), an enterprise-grade cloud storage provider. By using our service, you acknowledge that your data is stored on Wasabi servers.
Encryption: We implement AES-256 encryption for data at rest and SSL/TLS for data in transit. We prioritize security, but remember that no method of transmission over the Internet is 100% secure.
4. Third-Party Disclosure
We do not sell your personal data. We share data only with the following service providers necessary to run our business:
- Wasabi: For file object storage.
- Stripe: For payment processing.
- AWS/Google Cloud: For hosting the application infrastructure.
We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
